Agreement to These Terms

By signing up for Fena Labs ("the Service"), you agree to follow these terms and conditions ("Terms of Service"). You can always find the latest version here. We may update these terms, so please check back regularly. We'll post any changes on our website.

Your Account

• To use the Service, you must create an account with your company's legal name, address, phone number, email, and other required information .

• We can refuse or cancel accounts for any reason.

• We'll use your email for communication.

• You're responsible for keeping your account and password secure.

• Make sure your information is accurate and up-to-date.

• Email support is only for paying customers.

• We can immediately terminate your account if you break these terms.

Using Our Service

• We give you a limited, non-exclusive, and revocable license to use the Service as long as you follow these terms.

• You cannot:

  • Copy or distribute the Service.

  • Change the Service.

  • Bypass any security features.

• If the law prevents you from using the service, you cannot use it.

Changes to These Terms

• We may update these terms.

• We'll give you 30 days' notice before major changes, unless those changes are due to legal requirements.

Payments

• The Service uses recurring payments ("Subscription Service").

• The "Subscription Fee" is a monthly fixed fee, which varies based on your chosen plan and any custom rates we apply.

• When you sign up, you authorise us to charge your account until you cancel.

• "Subscription Billing Date" is the day you begin your subscription. Your account will be automatically charged on this day each subscription period.

• You need valid billing details for paid accounts on live websites.

• Development accounts do not require billing details, and any revenue generated from them will not be used in the subscription fee calculation.

• If you use our Shopify app, billing will go through Shopify and follow their terms. We'll show you how we calculate your charges in your account's billing section. If your Shopify account uses a currency other than USD, we will convert all orders to USD using live market rates to calculate your subscription fee.

Cancellations and Termination

• Your subscription continues until you cancel or we terminate it.

• Cancel before the next billing date to avoid charges.

• To cancel, email support@fena.co and follow the instructions. The process will vary depending on your eCommerce platform and will be actioned within 2 working days.

• If your account is terminated:

  • You'll lose access to the Service.

  • You won't get any refunds.

  • You must pay any outstanding balance.

• If you cancel mid-month, you'll get a final invoice. Once paid, you won't be charged again.

• We can change or end the Service at any time.

Free Trial

• New users get a 14-day free trial, which we may extend.

• Your account won't be charged until you upgrade to a paid version.

Changes to Service and Prices

• Prices may change with 30 days' notice.

• We can change or stop the Service at any time.

• We're not responsible for any issues caused by these changes.

Our Responsibility to You

• We're not liable for any losses or damages from using the Service.

• You use the Service at your own risk.

• We don't guarantee the Service will always be available or error-free.

Ownership

• Fena Labs Ltd owns the Service and all its content.

What You Can't Do

• Don't use the Service for anything we don't allow.

• Specifically, you can't:

  • Collect data without our permission.

  • Send spam or create fake accounts.

  • Bypass security features.

  • Try to get passwords or mislead us.

  • Misuse support services.

  • Use robots or data mining tools.

  • Disrupt the Service.

  • Reverse engineer the software.

  • Compete with us.

  • Bypass access restrictions.

  • Harass or threaten our employees.

  • Damage our reputation.

  • Break any laws.

Third-Party Services

• The Service may work with other services.

• We're not responsible for those services.

• You are responsible for maintaining those 3rd party services and obtaining any needed licences.

Service Management

• We can monitor the Service and take action against violations.

• We can remove or disable content.

• We can modify, update, remove, or disable the service at any time without notice.

• Purchasing a service grants you the right to use it at the time of purchase. It does not grant the right to future updates.

Privacy

• We protect your privacy according to our privacy policy.

Governing Law

• These terms are governed by UK law.

• If you are an EU resident, you also have the protections of your local consumer laws.

• Any disputes will be handled in UK courts, though you can also use your local EU courts for consumer protection issues.

Other Important Information

• These terms are the complete agreement between us.

• If we don't enforce a term, it doesn't mean we're giving up that right.

• We can transfer our rights and obligations.

• We're not responsible for problems beyond our control.

• If any part of these terms is invalid, the rest still applies.

• We're not partners or employers.

• These terms are not to be interpreted against us.

• You wave any defense based on these terms being in electronic form, and not physically signed.
